The Problem in Recent Years: Implications. The way in which automobile accident victims are currently compensated for their personal injuries is suggested by the published results of a survey made in Philadelphia in 1954 by Temple University. The accident investigation records of the Philadelphia Police Department supplied the universe from which a representative sample of bodily injury cases was selected. Personal interviews were conducted with 185 respondents (147 in connection with nonfatal accidents and 38 in connection with fatal accidents). Particular attention was paid to (l) the "estimated costs of care and all other losses or expenses resulting from the accident" and (2) "the recovery made by the individuals." Because of the relatively small sample and the difficulties encountered in obtaining information, no absolute conclusions could be reached, but support was obtained for several important generalizations concerning the area and possibly other areas as well. It is eminently clear that the victims of automobile accidents as a group are subject to substantial out-of-pocket expenses only a portion of which is ever recovered. ... In balance the losses substantially exceed the recoveries." In about a third of the cases studied there was no recovery at all. While the principal reason for this was a failure to establish liability, other factors were also found to have an important bearing on the matter.
